{"id":62,"date":"2018-07-26T16:01:01","date_gmt":"2018-07-26T16:01:01","guid":{"rendered":"https:\/\/fundacionporlajusticia.accesia.info\/?p=62"},"modified":"2022-05-04T10:28:32","modified_gmt":"2022-05-04T10:28:32","slug":"justicia-restaurativa-en-el-salvador","status":"publish","type":"post","link":"https:\/\/fundacionporlajusticia.org\/en\/justicia-restaurativa-en-el-salvador\/","title":{"rendered":"Restorative Justice in El Salvador"},"content":{"rendered":"<h1 class=\"text-align-justify\">International Court of Restorative Justice in El Salvador<\/h1>\n<h2>Leader<\/h2>\n<p>Jos\u00e9 M\u00aa Tom\u00e1s y T\u00edo<\/p>\n<div class=\"field field--name-body field--type-text-with-summary field--label-hidden field--item quickedit-field\" data-quickedit-field-id=\"node\/48\/body\/es\/full\">\n<h2 class=\"text-align-justify\">Description<\/h2>\n<p class=\"text-align-justify\">The lack of institutional response to the victims of the armed conflict that was falsely closed with an Amnesty Law, recently declared unconstitutional by the Constitutional Chamber of the Supreme Court of Justice of El Salvador, determined that the Central American University (UCA) , through its Human Rights Institute (IDHUCA) and at the request of the Network of Committees of Victims of the armed conflict, will make the decision to create the International Court for the application of Restorative Justice.<\/p>\n<p class=\"text-align-justify\">This project is a form of non-governmental public policy, being made up of experts in justice and human rights from several countries such as Spain, Brazil, Paraguay, Chile, the United States and El Salvador itself. The Court is chaired by the President of the Foundation for Justice and has been established since 2009 in various localities or communities in the country to examine cases of massacres, summary executions, torture, rapes, forced disappearances, many of them still unknown to the system. of justice of the country, issuing respective sentences with the testimonies of all of them, legal foundations supported by international criminal law and human rights conventions, petitions from the victims and a review of the position of the Salvadoran State regarding them.<\/p>\n<h2 class=\"text-align-justify\">Objectives<\/h2>\n<ul>\n<li>Reflect on the way to proceed regarding the more than 80 cases presented to the prosecutor&#039;s office that are stalled<\/li>\n<li>Promote a Transitional Justice Law<\/li>\n<li>Strengthen the request to reopen the Jesuit case in the courts of El Salvador<\/li>\n<li>Initiate processes to meet victims and military\/police<\/li>\n<li>Listen to the victims and accompany those who went through the previous Courts<\/li>\n<\/ul>\n<p>In April 2017 Jos\u00e9 Mar\u00eda Tom\u00e1s i Tio chaired the <strong>ninth edition<\/strong> of this court in El Salvador, which culminated with the presentation, on March 21, 2018, of the sentence delivered in this edition. We want to thank the sponsors, collaborators and organizers of this great event for their contribution to the cause, giving space to justice where it has been silenced and distant from victims forgotten if not persecuted.
